Kern County Superior Court: Alternative Dispute Resolution Program
Definition

Alternative dispute resolution (ADR) refers to methods used to resolve disputes without formal adjudication. Proponents of ADR report resolutions achieved more quickly, at less expense, with greater satisfaction for all parties involved.

Overview

The most common types of ADR are arbitration and mediation. The court's arbitration program has existed for years, and remains unchanged. Working with the local Bar Association and community representatives, the court recently developed a civil mediation panel to encourage this method of dispute resolution.

Civil Mediation Panel

The court has developed a civil mediation panel as a public service. Panelists have complied with the court's requirements for training, experience and ethical standards. Information about panelists is available on the court website, and in 25 hard copy binders located throughout the courts. The court will notify litigants about ADR options, but will not pay for a mediator or refer cases to specific mediators. Market forces will channel work to the most effective mediators.
